The General Counsel of The Illinois State Toll Highway Authority, pursuant to enabling legislation (605 ILCS 10/15), is appointed by the Illinois Attorney General to serve as the Illinois State Toll Highway Authority's legal advisor and legal representative. The General Counsel oversees the Tollway's Legal Department and is responsible for the preparation and administration of the department budget.
This position reports directly to the Illinois Attorney General and the Tollway Executive Director. This position functions within all areas of the Authority.
The General Counsel is the legal representative of the Authority and is involved and may appear in all litigation concerning the Authority. As such, it is necessary that the General Counsel have trial experience.
The General Counsel is responsible for the preparation and/or review of all contracts, leases and agreements entered into by the Authority for the procurement of goods and services. Knowledge of contract law and of the State Purchasing Act and Procurement Code is essential.
The General Counsel provides guidance, advice and supervision to the Property Management Division of the Engineering Department in the areas of eminent domain and inverse condemnation for property being acquired by the Tollway.
The General Counsel acts as the legal advisor to the Chairman and the Board of Directors of the Authority and is responsible for the preparation of all Board resolutions and motions, and for advising the Board on all statutes affecting their conduct. The General Counsel must possess a working knowledge of the federal and Illinois statutes, the Illinois Open Meetings Act, the Illinois Freedom of Information Act and all requirements of Rutan.
The General Counsel must possess knowledge of the legislative process because the General Counsel prepares draft legislation, interacts with legislators and the Authority's legislative liaison, works on the passage of legislation and handles the reaction to and preparation of positions on pending legislation.
Salary: Commensurate with qualifications and experience. A minimum of ten years of experience as a practicing attorney with five years’ with a Federal and/or State agency. A background in management a plus.
